Q: What are my Voting Rights in the Property Owners Association?
A: One (1) vote for each Parcel owned. There are 112 Parcels in Victoria Park I.The vote of a Parcel is not divisible. If a Parcel is owned by one natural person, his right to vote shall be established by the record title. If a Parcel is owned jointly by two or more natural persons who are not acting as trustees, that Parcel's vote may be cast by the Living Unit's primary occupant designated.
Q: What restrictions exist in the governing documents on my right to use my Parcel?
A: Refer to Section 8. Use Restrictions of the Amended and Restated Declaration of Covenants Conditions, and Restrictions For Victoria Park I.
- Residential purposes only.
- No signs, advertising, notice or other lettering of any kind without permission of the Board of Directors.
- No temporary structures, including trailer or shacks.
- Each Owner shall keep his Parcel free and clear of trash and debris.
- Domestic pets ARE allowed. Except pit bulls, "wolf hybrids", or other dogs prone to or exhibiting aggressive behavior. No more than three (3) dogs.
- Recreation vehicles, boats, trailers, motorcycles, motor homes, bus, tractors may not be stored on the Properties outside of garages.
- Golf Carts and motorcycles are permitted as long as they are fully enclosed in a garage.
- No commercial vendor vehicle of any kind shall be permitted to be parked on a residential Parcel for a period of more than twelve (12) hours.
- The ARC must first approve any future exterior color changes, additions, alterations, or landscape alterations desired by Owners in writing.
- Owners shall maintain all landscaping in a neat and orderly fashion.
- A Wall or Fence MAY be constructed with prior Board approval.
- Carports, detached garages, storage sheds, barns or similar outbuilding structures are NOT allowed.
- Swing set, playhouse, tree house or other play equipment less than twelve (12) feet in height shall be permitted in the backyard with prior Board approval.
Q: What restrictions exist in the governing documents on leasing of my home?
A: No leases less than six (6) months. May only be leased twice in a calendar year. A copy of the signed lease must be provided to the Association for approval by the Board. The tenants must complete an Application provided by the Association along with a $150 application fee. Tenants may not move-in prior to Board approval.
Q: How much are the assessments for the Property Owners Association and when are they due?
A: Assessments are due Annually. The current annual assessment is $166.
Q: Do I have to be a member of any other association?
A: No
Q: Am I required to pay rent or land use fees for recreational or other commonly used facilities?
A: No
